1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Hardhat ("we", "us", or "our").

By downloading, installing, or using the Hardhat application or the MyCISRefund.com website (together, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Description of the Service

Hardhat is a paid subscription mobile application and web service designed for UK construction workers operating as CIS (Construction Industry Scheme) subcontractors. The Services provide tools to:

  • View and track CIS deductions made by contractors and reported to HMRC
  • Estimate potential CIS tax refunds
  • Record and categorise business expenses
  • Estimate Self Assessment tax liability including Income Tax and National Insurance contributions
  • Interact with HMRC systems to retrieve CIS data and support tax filing

3. Eligibility

To use the Services, you must:

  • Be at least 18 years of age
  • Be a resident of the United Kingdom for tax purposes
  • Be registered or intending to register as self-employed with HMRC, or otherwise have a legitimate business need for the Services
  • Have the legal capacity to enter into a binding agreement

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

We reserve the right to suspend or terminate your account if we reasonably believe that your account information is inaccurate, that you have violated these Terms, or that your use of the Services poses a security risk.

5. Subscriptions and Payment

5.1 Pricing

Access to the Services requires a paid subscription. Current pricing is displayed in the app and on our website. All prices include VAT where applicable.

5.2 Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you choose). Payment is taken at the start of each billing period.

5.3 Cancellation

You may cancel your subscription at any time through the app or by contacting us at privacy@myCisRefund.com. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

6. HMRC Integration

The Services may connect to HMRC's APIs to retrieve your CIS deduction data and support tax filing. By using these features:

  • You authorise Hardhat to access your HMRC data on your behalf through the Government Gateway OAuth process.
  • You acknowledge that you are granting us read access to specific HMRC data as described in our Privacy Policy.
  • You may revoke this access at any time through your HMRC online services account or by contacting us.
  • Hardhat relies on the accuracy of data received from HMRC. We are not responsible for errors or delays in data provided by HMRC.

7. Tax Estimates — Important Disclaimer

The tax estimation features of Hardhat are provided for informational purposes only and do not constitute professional tax, financial, or legal advice.

While we endeavour to provide accurate tax estimates based on current HMRC rates, thresholds, and allowances, you acknowledge and agree that:

  • Tax estimates are approximations and may not reflect your actual tax liability.
  • We do not account for all possible deductions, reliefs, or your individual tax circumstances.
  • You are solely responsible for the accuracy of data you input and for verifying any tax calculations before submitting returns to HMRC.
  • Hardhat is not a substitute for professional tax advice. We recommend consulting a qualified accountant or tax adviser for your specific circumstances.
  • We accept no liability for any errors in tax estimates, penalties, interest, or additional charges imposed by HMRC as a result of reliance on the Services.

We are a software provider. We do not act as your tax agent, accountant, or financial adviser.

8. Your Obligations

You agree to:

  • Provide accurate and truthful data when using the Services
  • Use the Services in compliance with all applicable laws and regulations
  • Not use the Services for any unlawful, fraudulent, or malicious purpose
  • Not attempt to circumvent any security features or access controls
  • Not upload viruses, malware, or any harmful content

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • No warranty: The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Tax liability: We do not accept any liability for the accuracy of tax estimates or for any loss, penalty, interest, or charge arising from reliance on the Services' tax-related features.
  • Indirect losses: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities.
  • Cap on liability: Our total aggregate liability to you shall not exceed the total subscription fees paid by you to us in the 12 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms.

You may stop using the Services at any time and request deletion of your account by contacting us at privacy@myCisRefund.com or through the app settings.

Upon termination, your licence to use the Services is immediately revoked. We will retain your data in accordance with our Privacy Policy and applicable law.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email at least 30 days before changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
